§ 10-76. Warnings.

  • (a)

    Before issuing an ejectment and exclusion notice under this chapter, the appropriate city official or law enforcement officer may, within their discretion, first give the person a warning and opportunity to desist from public nuisance conduct, or the violation of law or rule; provided however, a warning to cease and desist is not required before issuing an ejectment and exclusion notice that makes reentry a public nuisance.

    (b)

    Notwithstanding the provisions of this section, no warning shall be required if the person is to be ejected or excluded for engaging in conduct

    (1)

    That is classified as a felony crime, or attempt, solicitation or conspiracy to commit a felony, or misdemeanor under Title 16, Chapter 1 of the Code of Laws of the State of South Carolina, or a misdemeanor crime under the Laws of the State of South Carolina and the Code of Ordinances for the City of Myrtle Beach, or

    (2)

    For which the person previously has been warned or excluded for committing in a public place.
