§ 10-77. Notice.
(a)
The appropriate city official or law enforcement officer must provide adequate notice to the person ejected and excluded from any public place that further reentry within a specified period of time shall result in the commission of a public nuisance.
(b)
The method of delivery may be by regular mail or may be delivered orally in person, if it contemporaneously followed by an attestation of oral delivery by way of public record, and there is no reasonable means to achieve delivery of written notice because the offender has fled, there is no known address or way to ascertain an address or the person declines to accept a written notice. No signature attesting to the offending person's receipt is required when the appropriate city official or law enforcement officer attests to the impossibility of written service.
(c)
When personal or mailed service is possible, the notice shall identify the offended rule, law or contain a brief description of the offending or public nuisance conduct, the places of exclusion, and the start date and end date of the exclusion period. The notice shall be signed by the appropriate city official or law enforcement officer and shall prominently display a warning of the consequences for failure to comply. The notice shall inform the excluded person of the right to appeal, including the time limit and the place of delivering the appeal.
