Article X. PAWNBROKERS |
§ 11-221. Daily records to be maintained for all purchase transactions; records to be delivered to chief of police; records to be maintained for two years.
(a)
Pawnbrokers shall maintain a legible record of all purchase transactions of regulated property. The following information must be maintained for each purchase transaction. Every pawnbroker shall keep a record, at the time of any loan, containing an account and description of the goods, articles, or things pawned, pledged, or purchased, the amount of money loaned thereon, the time of pledging them, the charges, or the rate of interest to be paid on the loan, and the name and residence of the person pawning or pledging the goods, articles, or things.
(b)
Regulated entities shall, in keeping the record required in subsection (a) above, take the following precautions to ensure the accuracy of the personal identification required by:
(1)
Requiring the customer as a condition of the purchase or pawn to sign his name on the blanks provided in the registration form approved by the state for use.
(2)
Requiring the presentation of a personal identification card.
(c)
A regulated entity shall maintain or cause to be maintained the information required by this section for not less than two years from the date of the purchase transaction.
(d)
Records kept by pawnbrokers pursuant to this chapter must at all reasonable times be open to the inspection by court officials, law enforcement officers, the administrator of the department of consumer affairs, and their designees. Any loan records identifying any individual must be handled in a confidential manner at all times.
(e)
All regulated entities shall, not later than 10:00 a.m. of each business day deliver or cause to be delivered to the chief of police a full and complete copy or transcript of the record in which is entered the transactions of the preceding day as required by subsection (a).
(1)
Electronic submittal. The submission of this report will be completed by electronic data submission through a modem or similar device, in such a format that the data is capable of direct electronic entry into the Horry County Police Department's computerized pawn system in the order required per the chief of police or his designated agent. This report will be provided by use of an electronic Microsoft Office Excel template provided to each business and electronically sent to the designated electronic location. An electronic receipt will be sent to the business upon submission. All pawnbrokers are required to have the designated software to perform this submission and must come into compliance within 90 days of the enactment of this article. A transaction reported by electronic transmission under this section shall not be reported on paper forms unless requested by any law enforcement official for investigative purposes. If the business computer system providing electronic submission is disabled (email software/modem capabilities),temporary use (not to exceed seven business days) of a compact disc is acceptable however documentation and approval must be made to the chief of police or the chief's designee, prior to this submission. If the business computer system's hardware is disabled, temporary use of hand written forms approved by the state department of consumer affairs may be used (not to exceed seven business days), however, documentation and approval must be made to the chief of police or the chief's designee, prior to this submission. Any extension of the use of secondary submissions must be approved by chief of police or his designee.

Failure to provide may result in suspension or revocation of business license. Failure to utilize an electronic data transmission system required by this section shall be grounds for the suspension or revocation of the pawnbroker's business license, unless the exemptions apply or good cause shown. If, after establishing the format and requirements for the transmission of computerized reports of transactions, the police chief alters the required format, pawnbrokers shall be given at least 30 days to comply with the new format requirements.
