§ 12-80. Authorization; parking restrictions subject to enforcement; owner responsibility.

  • (a)

    Subject to city council approval by resolution, the manager may create administrative public parking policies, reviews, appeals, exceptions, procedures, establish fees, contract with a parking authority or authorize and contract for parking management and enforcement of any provision or requirement of article III, including but not limited to any metered parking, timed parking, prohibited parking, resident decal parking, non-resident golf cart decals, guest placard parking, hang tag parking and any other approved parking plan or restriction in article III.

    (b)

    Nothing herein shall limit the police power of law enforcement. All municipal parking violations established under this article shall be subject to civil fines only, and not subject to criminal penalties, except as otherwise provided herein or as mandated by the general law of the state.

    (c)

    Enforcement and administration shall be pursuant to this article and such written policies and procedures as are approved by the city manager for that purpose, inclusive of the amount of such fines, charges for issuance and charges for replacement of decals, placards or hang tags, which shall be approved in reasonable amounts and incorporated into a schedule of fees, to be approved by council resolution.

    (d)

    Metered or pay to park. Whenever the city council shall determine, after consideration of such study as deemed instructive, and after a public hearing, that designated public spaces shall be subject to immediate prepayment for a certain time, it may designates by resolution such spaces for public purposes appropriate for parking, traffic control, economic viability or residential stability, or some combination thereof

    (e)

    Parking districts.

    (1)

    Whenever the city council shall determine after consideration of such study as deemed instructive of a particular area of the city and after a public hearing, that such an area is significantly impacted by nonresidential on-street parking by reason of commercial, industrial, recreational or institutional uses, it may designate by ordinance such area as a permit parking district for public purposes appropriate for parking, traffic control, economic viability or residential stability, or some combination thereof. For this article, a permit may be in the form of a placard, hang tag, decal, pass or permit, in the manager's discretion.

    (2)

    Issuance and cancellation of permits. When an area has been designated as a permit parking district, the city manager or his designee shall issue and cancel permits by according to the policies and procedures established by the city manager for the permit parking district.

    (3)

    Obedience to parking regulations. No permit issued under this division shall entitle a vehicle to park on yellow lines, in bus stops, in loading zones, near fire hydrants or in other prohibited zones.

    (4)

    Parking restrictions. It shall be unlawful for any person to park in a permit parking district without a permit during the time established for the permit parking district.

    (f)

    Parking tag or placard districts.

    (1)

    Establishment. Whenever the city council shall determine, after consideration of such study as deemed instructive of a particular district of the city, that such an area better serves the public good as long-term parking by reason of adjacent commercial or recreational use, it may designate such streets as parking tag districts, provided that the public shall have the right at all times when spaces are available, on a first come, first served basis, to use the spaces for short-term parking as provided by parking regulations, or may limit such use to residents only.

    (2)

    Issuance and cancellation of tags or placards; tag or placard fees. When an area has been designated as a parking tag or placard district, the city manager or his designee shall issue and cancel parking tags according to the policies and procedures established by the city manager for the parking tag or placard district. Fees for the tags or placards shall be fixed by the city manager, and approved by Council resolution.

    (g)

    Timed and reserved parking.

    (1)

    On-street parking. The operator of a vehicle may park, stop, or stand the vehicle in any on street location where parking, stopping, or standing is not otherwise prohibited or restricted under provisions of this chapter or under the state's Uniform Act Regulating Traffic on Highways.

    (2)

    Parking on streets in zones posted with a time limit is permitted free of charge for a period not to exceed the time limit posted. Parking for a period beyond that time limit is unlawful.

    (3)

    No person shall move or reposition a vehicle parked on a street to another street location in a zone having a posted time limit for purposes of avoiding the posted time limits.

    (h)

    Reserved parking.

    (1)

    No person shall park, stop or stand a vehicle in any reserved space in any city parking facility or city parking lot, unless the space has been assigned to the vehicle by the city enforcement authority.

    (2)

    No person shall park, stop or stand a vehicle in any city parking facility or city parking lot which has restricted parking for the facility as a whole without a parking decal, parking permit, parking card or other appropriate authorization provided by the city.
