§ 14-304. Restriction of assembly in certain congested areas abutting Ocean Boulevard during certain periods.

  • (a)

    Due to the resulting impact of vehicular and pedestrian congestion on the public rights-of-way, during the period from March 1 through October 31 each year, no person shall establish any outdoor assembly area on private property adjacent to the right-of-way of Ocean Boulevard between 6th Avenue South and 2nd Avenue South and between 7th Avenue North and 14th Avenue North. For the purposes of this section an assembly area is any area on privately owned property on which guests or invitees of the private property owner or other person in control of the property are permitted to stand or sit while drinking alcoholic beverages unless such area is at least ten feet from the public right-of-way or separated from the right-of-way by a permanent fence or wall 42 inches in height.

    (b)

    During the period from March 1 through October 31 each year, no person shall place, install, or maintain any table, chair or bench outdoors on private property within ten feet of the right-of-way of Ocean Boulevard between 6th Avenue South and 2nd Avenue South and between 7th Avenue North and 14th Avenue North unless such tables, chairs or benches are separated from the public right-of-way by a permanent fence or wall 42 inches in height.
