§ 20.5-13. Removal.

  • (a)

    Within 30 days following written notice from the city, any telecommunications provider or other person that owns, controls, or maintains any unauthorized telecommunications facility or related appurtenances on, in, under or above the streets shall, at its own expense, remove such facilities and appurtenances from the streets.

    (b)

    A telecommunications facility is unauthorized if the franchise of the applicable telecommunications provider has expired or has never been obtained, if the facility has been abandoned, or if the construction of the facility was not in compliance with this chapter and the consent agreement or franchise agreement. A utility pole shall be deemed to be abandoned whenever all wires, lines, cables, and other facilities have been removed from the pole for a period of 30 days or more.

    (c)

    Any abandoned utility pole which is not removed by the telecommunications provider as provided in this section may, after ten days written notice, be removed by the city. In the event of such removal by the city, the telecommunications provider shall pay the city for all costs incurred by the city to have the pole removed.
