§ 20-23. Plat submission for final review.

  • (a)

    The final plat shall constitute only that portion of the approved preliminary plat that the subdivider proposes to record and develop at the time of submission. Approval of the final plat shall be subject to the installation of the improvements designated in article III of this chapter or certified evidence from the city that the improvements shall be installed in accordance with these regulations.

    (b)

    The procedure for obtaining final plat approval is as follows:

    (1)

    Procedure.

    a.

    The subdivider shall submit to the city planning director within one year of the date of preliminary plat approval at least six prints of the final plat and a digital copy pursuant to digital submittal guidelines.

    b.

    The city planning director shall forward the plat within 30 days of the regularly scheduled meeting of the planning commission to city departmental offices for review and certification, if approved.

    c.

    The plat shall then be submitted to and checked by the planning commission for conformance with the approved preliminary plat and with the requirements of these regulations. The planning commission shall notify the subdivider in writing of any noncompliance with these regulations or any deviation from the approved preliminary plat which is found on the final plat or submit a report to the city council certifying approval of the final plat within 30 days after its submission to the planning commission.

    e.

    The approved final plat must be recorded with the register of deeds within 12 months after approval by the planning commission. Should the 12-month time limit expire before the plat is recorded, it must be resubmitted to the city planning director for reprocessing. It shall be unlawful to sell or transfer property (lots) within the approved subdivision until after the plat has been recorded with the register of deeds.

    (2)

    Final plat requirements. The final plat shall be drawn at the same scale and on the same sheet size as the preliminary plat and shall conform substantially to the preliminary plat, as approved. The final plat shall be prepared by a SC-registered land surveyor and shall show the following information:

    a.

    Name and address of owner of record and Horry County tax map number.

    b.

    Name of subdivision, date, north arrow and graphic scale.

    c.

    Name and seal of SC-registered land surveyor.

    d.

    Name of municipality or county in which subdivision is located.

    e.

    Exact boundaries of the tract of land being subdivided shown with bearings and distances.

    f.

    Streets and alleys (labeled as public or private), rights-of-way and street names.

    g.

    Lot lines and lot and block numbers.

    h.

    Minimum building setback lines.

    i.

    Parks, school sites or other public open spaces, if any.

    j.

    Accurate description of the location of all monuments and markers.

    k.

    Existing railroads, watercourses, floodplains, and city limit lines.

    l.

    Utility easements, widths, and layouts for:

    1.

    Water mains;

    2.

    Gas and electrical lines; and

    3.

    Sanitary and storm lines; and

    4.

    Storm drain lines and detention ponds (labeled as public or private).

    m.

    Forms for final certification. The following certificates shall be lettered or rubber-stamped on the final plat in such a manner as to ensure that the certificates will be legible on any prints made therefrom:

    1.

    Certificate of accuracy:

    It is hereby certified that this plat is true and correct to the accuracy required in the Myrtle Beach Subdivision Regulations.

    2.

    Certificate of approval of the installation and construction of streets, utilities, and other required improvements.

    or (2) that a guarantee of the installations of the required improvements in an amount or manner satisfactory to the City of Myrtle Beach has been received.

    3.

    Certificate of ownership and dedication.

    I (We) hereby certify that I am (we are) the owner(s) of the property shown and described hereon and that I (we) hereby dedicate all streets, alleys, walks, parks, and other sites to public or private uses as noted.

    4.

    Certificate of acceptance of dedications.

    I, ___________, the city clerk of the City of Myrtle Beach, South Carolina, do hereby certify that on the _____ day of ________, the city council of the City of Myrtle Beach accepted the dedication of the streets, easements, rights-of-way, and public parks and other sites for public purposes as shown hereon.

    5.

    Certificate of approval for recording plat.

    Provide a box at least three inches by three inches for the planning commission approval stamp.
