§ 12-150.10. Residential parking restricted area from 31 avenue north to 82 avenue north, bounded by the Atlantic Ocean and Kings Highway.

  • (a)

    Unless otherwise defined within this Section, public parking is specifically managed in an area from 31 st Avenue North to 82 nd Avenue North, bounded by the Atlantic Ocean and Kings Highway, as to location, seasonality, time and cost so that the residential character of the neighborhood is protected while providing public parking.

    (b)

    Except for residents parking with decals issued under Section 12-141, or guest placards as limited in Section 12-160 (c), street side parking is prohibited on the public right of way in the Avenues, including all public thoroughfares however named within the designated area.

    (c)

    As distinguished from any resident decal program under Section 12-141, upon presentation of proof of either four-percent or six-percent ownership of property within the designated area, each household shall be entitled to four guest parking placards for permanent use which shall permit street side parking only within the designated area of the avenues, however named. The placards shall be coded in such a way as to be applicable only on the street where the qualifying household's residence is located, and may only be used in the avenues in the designated area. Guest parking placards are not valid for use on the street ends or Ocean Boulevard. Guest placard parking is prohibited on Ocean Boulevard where resident decal parking is only permitted, an in any metered or timed space, including street ends.

    (d)

    As distinguished from any resident decal program under section 12-141 or guest parking placard program under subsection (c), a non-resident property owner owning six-percent tax property and who owns a golf cart properly decaled by the State of South Carolina shall be eligible to have one non-resident golf cart decal, the use of which shall be permitted on any street end parking only, within the city limits.

    (e)

    It shall be unlawful for any person to park any vehicle in any avenue or area so restricted as to location and season, unless the vehicle or golf cart displays a valid and current parking decal or guest parking placard.

    (f)

    The majority of adult residents of an avenue may opt out of signage that provides notice to the public of the restriction of section 12-103(a)—(d). Upon approval of said petition by the city manager or designee, no signage shall be erected, and parking shall not be regulated as provided herein, except as to public safety violations address elsewhere in state or local law.
