§ 19-203. Recurring congestion traffic management.

(a)

Generally. Traffic management of recurring traffic congestion involves long range planning and strategies in the capital improvements area, and more immediate implementation of counter measures.

(b)

Recurring congestion traffic management counter measures. Upon the roadway system as herein classified, traffic management of recurring traffic congestion is made necessary upon law enforcement observation of the existence of significant disruption to the public safety of an overburdened roadway segment, or the existence of congestion traffic that acts to dramatically impact and disrupt normal functional operation of the transportation system, as a result of increased travel demand and/or decrease in roadway capacity. Upon law enforcement confirmation and fulfillment of the conditions set forth herein, and upon implementation of adopted police department policies and procedures, all private vehicles that enter the city limits of Myrtle Beach will be subject to congestion traffic management counter measures, and such counter measures shall constitute the lawful instructions of an official traffic control measure, including individual law enforcement directives, placement of barriers, devices, signs, signals or markings by the city, whether manually, electrically or mechanically operated. Congestion traffic management counter measures shall only exist while the congestion conditions exist in the identified area. Counter measures shall not apply to public safety, public works or emergency vehicles. Upon law enforcement confirmation of congestion traffic as set forth herein, the approved options of counter measures may be implemented by the manager, or his designee in such order or combination in their discretion that will ease congestion and preserve public safety, health and welfare. Recurring traffic management counter measures shall include:

(1)

If and when permitted by the State of South Carolina, enhanced arterial management consisting of traffic signal operations, management, maintenance and timing; and road/lane access management; or

(2)

Future institution of real time traffic information systems for drivers, enhanced roadway performance and/or additional infrastructure; or

(3)

Development of law enforcement traffic incident management protocol; or

(4)

One or more counter measures for incident/nonrecurring traffic congestion, when applicable. Congestion traffic management counter measures shall only exist while the congestion conditions exist in the identified area. Counter measures shall not apply to public safety, public works or emergency vehicles. Upon law enforcement confirmation of congestion as set forth herein, the approved options of counter measures shall be implemented by the manager, or his designee in such order or combination in their discretion that will address the problem.
